COMPETITION TERMS AND CONDITIONS

1 THE PROMOTER

1.1  The "Promoter" means the company promoting this competition. Being Extreme Watersport Pty Ltd ABN 18 603 044 846, Registered office 1621 Point Nepean Road, Capel Sound, VIC 3940

2 WHO MAY ENTER

2.1 This competition is not open to an employee, officer, servant or contractor of the the promoter, or its related entities.

2.2 This competition is not open to a person who refuses to comply or breaches any of these terms and conditions.

2.3 All contestants acknowledge that the promoter may rely on clause 2 at any time, even if the promoter only learns of a persons ineligibility after the promoter has nominated the person as the finalist or winner, even if the prize has already been awarded. return of prize or cancellation of prize may be required if ineligibility is discovered under clause

3 ENTRY INTO COMPETITION 

3.1 Information on how to enter and prizes form part of these terms and conditions. Any entry not complying with the terms and conditions will be deemed invalid

3.2 Entry into this competition constitutes full acceptance of these terms and conditions

3.3 This competition commences at midnight on 1st July 2017 and concludes with announcement of winners at 7:00PM on 4th of October 2017. 

3.4 Entries for the grand prize close midnight on 16th September 2016

3.5 entries for instant win prize close as soon as the winning entry is drawn

3.6 This competition is a game of skill, Chance plays no part in determining the winner

3.7 This competition is open to anyone of any age who abides by the conditions of entry set out here in

3.8 Participants are encouraged to take a selfie with their cray and upload the photo to Facebook or Instagram using the Hashtags #ExtremeWatersport #RedBoats #CrayDiveVictoria. For the avoidance of doubt, a selfie is optional and not a requirement of the competition. If the participant opts to take a selfie they do so at their own risk and cannot make a claim whatsoever on the promoter for any damage howsoever caused!

3.9 By entering the competition, entrants agree to allow the promoter to repost their submission on whichever social media or other mainstream media or advertising material that the promoter may see fit

4 PRIZES

4.1 Not withstanding anything else in these Terms and Conditions, the promoter has absolute discretion and final say in awarding prizes in this competition

4.2 Winners will be judged by By Extreme Watersport, at 1621 Point Nepean Road, Capel Sound  and announced at 7:00PM on the 4th of October 2015.

4.3 The promoter reserves the right to disqualify any entrant or entry that in the opinion of the promoter includes objectionable content, including but not limited to profanity, full frontal nudity, potentially insulting, scandalous, inflammatory, or defamatory images or langauge
4.4 The 1 winning entry for the INSTANT PRIZE drawer will recieve free air fills on 1 cylinder or 1 set of win cylinders nominated by the winner. Free air fills are only available to the winner for use on that 1 cylinder, free air fills are non transferable and cannot be used for any commercial purpose. maximum of 14 free air fills will be provided in any 7 day period. Prize value varies but total prize value of up to $784.

4.5 The winner of the GRAND PRIZE drawer will recieve a $100 Extreme Watersport Gift Card and a Redboats Gift Card Entitiling the diver to one free standard single boat dive. total prize value of up to $170

4.6 Winners will be announced at Extreme Watersport Social night, Online and via social media.

4.7 All prize values are set including GST, the promoter takes no responsibility for fluctuations or variance in prize value

4.8 Prizes are non transferable, non refundable, non exchangeable and cannot be redeemed for cash. No modifications or changes are available on prizes

5 EXCLUSION OF LIABILITY

5.1 The promoter takes no responsibility for loss of prizes 

5.2 The promoter shall not be liable for any loss, damage or injury suffered or sustained (including but not limited to consequential loss), including for personal injury or property damage suffered or sustained as a result of entry into the competition or as a result of acceptance of prizes (unless required by law)

5.3 By entering this competition you release indemnity to the promoter against all liability, cost, loss, or expense arising out of acceptance of any prize or participation in any competition including (but not limited to) personal injury and damage to property and whether direct or indirect, consequential, forseeable, due to some negligent act or omission or otherwise

5.4 The promoter assumes no responsibility for any error,defect delay, theft or unauthorised access to entries. Subject to any written directions provided under law. If for any reason the competition is not capable of operating as planed, including infection by computer viruses, tampering, unauthorised intervention, fraud or any other causes beyond the control of the promoter which corrupts  or alters the administration, security, fairness or proper conduct of the competition, the the promoter reserves the right, at its sole discretion to disqualify any individual or entry, to cancel, modify, suspend, terminate or to withdraw the competition at any time.

5.5 This promotion is in no way sponsored, endorsed, administered, or associated with Facebook, or Instagram or any other social media platform

 

6 OWNERSHIP OF ENTRIES 

6.1 Competition entries and material submitted in connection with any competition (whether written, audio, electronic, visual or a combination of these), including any photos or video or audi taken of competitors are assigned to the promoter upon submission and become part of the property of teh promoter upon submision, which the promoter may use in any way they see fit. Copyright of any such material is assumed by the promoter.

6.2 All entries and materials remain the property of the promoter (subject to confidentiality)

6.3 Each entrrant warrants that he or she owens the copyright and all otehr rights/ intelectual property in such material submitted and they have full power or authority to agree to and grant the above assignment, consent and other rights to the promoter
